Kalshi Seeks Injunctive Relief from Cease-and-Desist Orders Issued by Nevada and New Jersey Gaming Boards
Kalshi, a financial exchange and prediction market platform, is currently facing legal issues as it seeks injunctive relief from cease-and-desist orders issued by the Nevada and New Jersey gaming boards. The platform allows users to trade on the outcome of real-world events, including sports events, through event contracts.
Nevada Gaming Control Board’s Cease-and-Desist Notice
In early March, the Nevada Gaming Control Board (NGCB) sent a cease-and-desist notice to Kalshi, demanding the company to stop offering sports event contracts in the state by March 14. Despite this order, Kalshi did not comply.
New Jersey Division of Gaming Enforcement’s Cease-and-Desist Letter
Following Nevada’s actions, the New Jersey Division of Gaming Enforcement (DGE) also issued a cease-and-desist letter to Kalshi and Robinhood on March 27. The companies were given until March 29 to remove their sports event contract markets from New Jersey.
Legal Actions Taken by Kalshi
Kalshi has decided to challenge the orders from both Nevada and New Jersey. The platform filed a lawsuit against Nevada, alleging that the NGCB violated the Commodity Exchange Act (CEA) by trying to regulate a federally-approved derivatives exchange that falls under the jurisdiction of the Commodity Futures Trading Commission (CFTC).
Additionally, the lawsuit argues that allowing individual states to impose restrictions on federally-regulated entities like Kalshi would create regulatory conflicts that go against the intentions of Congress.
Violation of New Jersey’s Constitution
Both Kalshi and Robinhood are accused of violating New Jersey’s constitution by offering event trading on college sports, which is prohibited by existing state laws. Despite efforts to engage with regulators and educate them on prediction markets, the cease-and-desist orders were issued.
